By accessing or using FSA Receipt Tracker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms from time to time; continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

2. Description of the service

FSA Receipt Tracker is a software tool that connects to your Gmail account (read-only) to identify receipt and order confirmation emails, and uses AI to classify purchases as potentially eligible or ineligible for Flexible Spending Account (FSA) or Health Savings Account (HSA) reimbursement. The Service provides a dashboard summarizing these classifications to help you organize reimbursement claims.

3. Not tax or benefits advice

FSA Receipt Tracker is not a tax advisor, benefits administrator, or legal advisor.

The FSA/HSA eligibility classifications provided by this Service are generated by AI and are for informational purposes only. They do not constitute tax advice, legal advice, or a guarantee of reimbursement. FSA and HSA eligibility rules vary by plan, employer, and jurisdiction, and are subject to change.

You are solely responsible for verifying eligibility with your FSA/HSA plan administrator before submitting any reimbursement claim. We make no warranty that any classification produced by this Service will be accepted by your plan administrator or the IRS.

4. User responsibilities

By using the Service, you agree to:

• Provide accurate account information and keep it up to date
• Use the Service only for lawful personal purposes
• Not attempt to reverse engineer, scrape, or interfere with the Service
• Not use the Service on behalf of others without their explicit consent
• Take responsibility for any reimbursement claims you submit to your FSA/HSA administrator based on information from this Service

5. Data usage

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

We grant read-only access to your Gmail account solely to scan for receipt-related emails. We do not read, store, or process emails outside of that purpose.

6. Account termination

You may stop using the Service at any time and request deletion of your account and data by emailing hello@cliffdong.com. We will process deletion requests within 7 days.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or are misusing the Service.

7. Limitation of liability

To the maximum extent permitted by applicable law, FSA Receipt Tracker and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:

• Denied FSA/HSA reimbursement claims based on our classifications
• Tax penalties or audit findings related to FSA/HSA submissions
• Loss of data or interruption of service
• Unauthorized access to your account

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.
